By using Shiksak, you agree to comply with all of the terms and conditions hereof. The right to use Shiksak is personal to you and is not transferable to any other person or entity. You are responsible for all use of your Account ((under any screen name or password) and for ensuring that all use of User’s Account complies fully with the provisions of this Agreement. 2. CHANGED TERMS
Shiksak shall have the right at any time to change or modify the terms and conditions applicable to User’s use of this site, or any part thereof, or to impose new conditions, including, but not limited to, adding fees, courses and charges for use. Shiksak offers paid Services (depending on the membership level) for a fee. Unless displayed otherwise, all fees are quoted in INR in India and U.S. Dollars for the rest of the world. You are responsible for paying all fees and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. User shall make payment for courses as stipulated in this website either through credit, paypal or any other means as stipulated by Shiksak. Refunds may be available for paid courses and membership fees as described in our Refund Policy.
3. DESCRIPTION OF SERVICES
Through its Web property, Shiksak provides you with access to a variety of courses, such as to provide people an avenue for to acquire knowledge and skills to compete in this 21st century (collectively “Services”). If you are an instructor at Shiksak, it is your responsibility to ensure your lesson contents , course descriptions and any other materials that you publish and use to teach at Shiksak are free from copyright violations laws. We take copyright violation very seriously. If you are found in breach of copyright violation, your access to the website will be terminated. Shiksak and its administrators shall not be held responsible for any such acts.

5. USER CONTENT

6. MEMBER ACCOUNT, PASSWORD, AND SECURITY
Our services require you to open an account, you must complete the registration process by providing Shiksak with current, complete and accurate information as prompted by the applicable registration form. You will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under User’s account. You agree to notify Shiksak immediately of any unauthorized use of your account or any other breach of security. Shiksak will not be liable for any loss that you may incur as a result of someone else using User’s password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Shiksak or another party due to someone else using User’s account or password. By joining promotional events (like workshops, webinars etc) conducted at Shiksak, you give Shiksak permission to use the event contents for further promotional purposes.
7. Modifications of Course
We will ensure you an uninterrupted world class course; however we wish to intimate you of the fact that unexpected events do occur. Shiksak reserves the right to cancel, interrupt, or reschedule any course or to modify any course content or the point value or weight of any assignment, quiz, or other assessment. All courses offered are subject to the Disclaimers and Limitation of Liability section.
8. Academic Credit granting
Except explicitly indicated by a credit-granting institution, participation in or completion of any course does not confer any academic credit whatsoever. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a course unless you have earned a Course Certificate (or other equivalent Shiksak credential) for that course. Shiksak, its course instructors, and the associated participating institutions have no obligation to have a course recognized by any educational institution or accreditation organization.
9. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY
A. You expressly agree that use of Shiksak is at your sole risk. neither Shiksak, its affiliates nor any of their respective employees agents, third party content providers or licensors warrant that Shiksak courses and services will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Shiksak or as to the accuracy, reliability or content of any information, service, or courses provided through Shiksak
B. Shiksak is provided on an “as is” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of quality of content of courses, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
C. this disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, , whether for breach of contract, tortious behavior, negligence, or under any other cause of action. user specifically acknowledges that Shiksak is not liable for the defamatory, offensive or illegal conduct of other users or third-parties and that the risk of injury from the foregoing rests entirely with user.
D. in addition to the terms set forth above neither, Shiksak, nor its affiliates, course instructors or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or inauthenticity of, the courses contained within Shiksak, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages.
E. force majeure neither party will be responsible for any failure or delay in performance due to circumstances beyond its reasonable control, including , without limitation, acts of god, war, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, service outages resulting from equipment and/or software failure and/or telecommunications failures, power failures, network failures, failures of third party service providers (including providers of internet services and telecommunications). the party affected by any such event shall notify the other party within a maximum of thirty (30) days from its occurrence. The performance of this agreement shall then be suspended for as long as any such event shall prevent the affected party from performing its obligations under this agreement.

12. REFUND POLICY
If you are not entirely satisfied with our service, you are entitled to a refund. This policy outlines a transparent approach to refunds giving you a great platform experience.
Here are the situations in which we expect you to seek a refund on an item and related services you subscribed to:
A service/course is promised but not provided
If a service doesn’t work the way it should and it cannot be easily fixed you are entitled to a refund.
Also if a course as advertised and you are not provided with that package in accordance with our term and conditions then you are entitled to a refund.
If a purchased course doesn’t work properly or not upto the student’s satisfaction, student can seek for a refund within 14 days by contacting firstname.lastname@example.org. Our team will evaluate the concern and provide refund if the explanation is found satisfactory.
We promise to avoid this situations prior to or after you subscribe to our service, but refunds will be made by crediting user’s account 30 days after request has been made by you.
For the instructor membership fees , the instructor can apply for refund within 14 days of the purchase by sending mail to email@example.com if its not upto the instructor’s satisfaction.
13. PROHIBITED USES

User may terminate this agreement by a written notice to Shiksak 30 days before the time of termination.
This Agreement and any operating rules for Shiksak established by us constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the United Kingdom [YOUR STATE/PROVINCE], United Kingdom [YOUR COUNTRY], without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. 18. DISPUTE SETTLEMENT
If we can’t resolve our dispute amicably, you and Shiksak agree to resolve any claims related to these Terms (or our other legal terms) through final and binding arbitration, regardless of the type of claim or legal theory.

Users represents and warrants that (i) the credit card information supplied is true, correct and complete and (ii) charges incurred by the User will be honored by the User’s credit card company and (iii) User shall pay charges incurred by User at the amounts in effect at the time incurred, including all applicable taxes.
Shiksak reserves the right in its sole discretion to edit or delete any information, course or content appearing on the Site and to remove any services for sale. Upon notice published over the Service, Shiksak may modify this Contract, or prices, and may discontinue or revise any or all aspects of the Site in its sole discretion and without prior notice.
